Terms of Use
The agreement between your business and us when you use LimaPOS.
Effective 12 October 2026
1. About these terms
LimaPOS (the "Service") is owned and operated by Dexlab Technologies Ltd, company registration number PVT-PJUE8VZ ("we", "us"). These terms apply when you create an account or use the Service. By doing so you agree to them on behalf of your business. If you don't agree, please don't use the Service. Our Privacy Policy explains how we handle personal data and forms part of these terms.
2. Accounts
- Give accurate information when you sign up and keep it up to date. You must be authorised to accept these terms for the business you register.
- The person who creates the account manages it for the business, including the staff they invite and the access each person gets.
- Keep passwords and two-factor codes private. You're responsible for activity under your account, and you should tell us promptly at support@limapos.africa if you think someone has accessed it without permission.
3. Plans, trials and payment
- The features, user and branch limits, and price of each plan are those shown when you subscribe. Tools not included in your plan stay unavailable until you change plans.
- A free trial lasts for the period shown at sign-up. You don't need a payment card to start one.
- Paid plans are paid in advance for the period you choose (for example a month or a year) through the payment options shown at checkout.
- If a plan expires without payment, your account becomes read-only: you can still sign in, view and export your records, but you can't make new sales or changes until you renew.
- There are no setup fees and no long-term contract. If you think you've been charged in error, contact us and we'll look into it.
4. Acceptable use
Use the Service only for lawful business purposes. You must not:
- store or send unlawful, fraudulent or infringing content, or process data you have no right to process;
- try to access another business's account or data, or any system or network behind the Service, without authorisation;
- probe, scan or test the Service for vulnerabilities, or get around sign-in, rate limits or other security controls (if you find a security problem, please report it to us instead);
- disrupt the Service or overload it, including with automated traffic;
- copy, reverse engineer, resell or sublicense the Service, except as these terms allow;
- use the Service to send unsolicited bulk messages or to impersonate anyone.
Unauthorised access to computer systems and data can also be an offence under Kenya's Computer Misuse and Cybercrimes Act, 2018.
5. Your data
Your business owns the data it enters. You allow us to host, process, transmit and display it only to run and support the Service for you. You can export your records to CSV or PDF at any time. You're responsible for the accuracy and lawfulness of the data you enter.
6. Your customers' data
When you record details about your customers, guests or staff, your business is the data controller and we process that data for you. You're responsible for having a lawful reason to collect it, telling those people how you use it, and handling their requests. In particular:
- only export customer contact details for marketing if those customers have agreed to hear from you;
- keep allergy and other health notes to what your staff need to serve the guest safely.
7. Payments you take
Money your customers pay by M-Pesa goes to the Till or Paybill your business connects, never to us. You're responsible for your M-Pesa account and credentials, and for checking that payments recorded in LimaPOS match what you received. A till that loses its connection keeps sales on that device until it reconnects; clearing the browser's data before then can lose them.
8. What the Service is not
LimaPOS includes bookkeeping, tax and reporting tools. They record and present what you and your staff enter. They aren't accounting, tax, legal or financial advice. You remain responsible for checking your books, tax figures and reports before you rely on or file them, and for meeting your own tax, licensing and record-keeping obligations. LimaPOS is not a KRA electronic tax register or eTIMS device.
9. Availability and warranties
We work to keep the Service available and reliable, but we can't promise it will be uninterrupted or error-free, and we may need to pause it for maintenance or for reasons outside our control. We may add, change or remove features; if we remove a feature your plan includes, we'll tell you in advance where reasonably practicable.
Apart from the commitments in these terms, the Service is provided "as is". Nothing in these terms limits any right you have under the Consumer Protection Act, 2012 or any other law that cannot be excluded by agreement.
10. Liability
As far as the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data, arising from your use of, or inability to use, the Service. This doesn't limit liability that the law doesn't allow us to limit. You agree to cover our reasonable losses arising from your breach of these terms or of the law, or from data you entered without the right to do so.
11. Suspension and closing
You can stop using the Service and ask us to close your account at any time. We may suspend or close an account if these terms are seriously breached, if it puts other users or the Service at risk, if the law requires it, or if fees remain unpaid. Where we reasonably can, we'll give notice first and a chance to export your data. After closure, data is handled as described in the Privacy Policy.
12. Intellectual property
The Service, including its software, design and trade marks, belongs to us or our licensors. These terms give you the right to use the Service, not ownership of it.
13. Changes to these terms
We may update these terms. When we do, we change the effective date at the top, and we tell account holders about material changes through the Service or by email where reasonably practicable. If you keep using the Service after a change takes effect, the new terms apply.
14. Governing law
These terms are governed by the laws of Kenya, and disputes will be handled by the courts of Kenya. If part of these terms can't be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement between us about the Service.
15. Compliance
We comply with GDPR principles, the Consumer Protection Act, 2012, and the Computer Misuse and Cybercrime Act (CMCA), 2018. See our Compliance page for what this means in practice.
